DECLARATION OF PERSONAL DATA PROTECTION

Svobody 956/31 Postal Code 779 00, Identification Number: 285 858 36, registered in the Commercial Register kept at the Regional Court in Ostrava in Section C, Insert 44002 (hereinafter "Gastroland"), we undertake to protect the provided personal data.

Below you will find information on how and how we handle the data in Gastroland, including information on how to contact us if you have any questions regarding the processing of your personal information. We undertake to handle your data to prevent abuse.

We undertake to take every precaution to prevent the misuse of personal information you provide to us. We will process your personal data only in the case of the existence of a legal title for the processing of personal data.

With regard to the adoption of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC - General Regulation on the protection of personal data - (GDPR), in order to protect the fundamental rights and freedoms of natural persons, we publish this Privacy Policy.

THE PURPOSE OF PROCESSING YOUR PERSONAL DATA IN GASTROLAND

We will process your personal data to the extent that we have been provided to you, including in particular: name, surname, email, gender, telephone number and date of birth. In addition, we will process information from cookies, payment and booking information, and information relating to your purchasing behavior gathered in the Lobsterka and Lobster Friends loyalty program.

We therefore process your personal data to the extent necessary for the provision of individual services and the introduction of our products and services that you negotiate with us either separately or processed for the purposes of our services, but it can not be ruled out that the legal basis for the processing of personal data will and another, unnamed, contractual relationship. If we are a personal data processor, which may not always be the case, we generally do not process personal data based on your consent but mainly for the reasons necessary for the performance of the contract or for the implementation of the pre-contractual arrangements to your request; we further process personal data because of the necessity to comply with the legal obligations that apply to us, or processing is necessary for the purposes of our legitimate interests. If, exceptionally, for example, due to sending our newsletter or accessing our loyalty program, we process your personal data on the basis of your consent, we also protect personal information in accordance with these privacy policies.

As part of the loyalty program, we will process your personal data to conduct marketing activities, conduct research and business statistics on purchasing behavior and loyalty program behavior, send business messages and invite us to events organized by Gastroland (including sending commercial messages by electronic means) technical and marketing information, by any means of communication (especially by e-mail, telephone, SMS, and push notifications from the Lobster mobile application).

If we process personal data on our legitimate interest grounds, these legitimate interests result, in particular, from a separate contractual agreement with you as a customer - subject of the data. Otherwise, our legitimate interests include simulation of products and services to help you choose the most advantageous product or our offer; research and development of products or services and market analysis, analysis of anonymized data for historical, statistical and scientific purposes.

LEGAL BASIS FOR PROCESSING

The legal basis for the processing of personal data is the applicable Czech legislation, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Regulation on the Protection of Personal Data - GDPR). The Czech legislation is the Act No. 89/2012 Coll., The Civil Code, as amended.

PROCESSING METHOD

We may process and process your personal data using, as a rule, exclusively automated procedures that will not normally have legal effects for you or will not affect you in a similar way (automated decision making). This means that personal data may be processed automatically in such a way that, for example, members of the loyalty program receive benefits and offers that match their preferences and / or interests according to the identified purchasing behavior. As a result of automated decision making, individual members of the loyalty program may receive different benefits and offers, or some of the offers and / or benefits provided may only be available to selected members of the loyalty program. For membership in our loyalty program, it is necessary to grant consent by automatic processing of personal data, including profiling, while the loyalty program does not allow membership without this consent. Personal data related to booking a table are processed manually and data is required to the extent strictly necessary for booking.

CATEGORY OF PERSONAL DATA

Gastroland does not process specific categories of personal data unless expressly agreed in a contract or other legal document, in which case the legal basis for the processing of such personal data will be discussed.

RECIPIENTS AND PERSONNEL DATA PROCESSORS

Gastroland may or must provide personal information in particular to the following categories of recipients:

public authorities and other entities, if required by the applicable law or imposed by decision of the administrative or judicial authorities;
accountants and tax advisors, or to its lawyers;
in the event of an insured event, the insurance undertaking and other entities, if this obligation results from the insurance contract concluded;
providers of postal and communications and electronic communications services;
payment service providers and payment processors and other services such as our bowling reservation system operator;
to other persons and entities, provided the nature of the services and products provided, or to such data subject, or if it is necessary for the legitimate interests of Gastroland.

THE PERIOD ON WHICH YOUR PERSONAL DATA ARE STORED

We keep your personal data for as long as is necessary and we archive it according to the statutory time limits imposed by the law. For example, in the case of a telephone reservation in the restaurant, we process personal data for as long as is necessary, usually 30 days from the date of booking.

The most recent processing of personal data we apply to you is usually 5 years from the date when the legal relationship was terminated or 10 years from the end of the taxable period in which the fulfillment occurred due to the fulfillment of legal obligations. The mentioned period of treatment follows, in particular, from Act No. 89/2012 Coll., The Civil Code, as amended, or from Act No. 235/2004 Coll., On Value Added Tax, as amended. After this time, all your personal information will be deleted if there is no other legitimate reason for longer processing time during processing.

We have strict internal rules that justify the legitimacy of keeping personal data.

The personal data we process with your consent is retained only for the duration of the purpose for which the consent was granted.

CAMERAS

Gastraland's premises include cameras that capture video and audio. Cameras are installed to ensure the safety of persons and property and also serve to protect against infringements. Records from the camera can be handed over to the Czech Police, if necessary, and, in case of danger of delay, the security agency guarding the Šantovka shopping gallery. Camera records are secured against theft, access to them is strictly limited to scanned persons, and are stored for a maximum of 5 days, then deleted.

YOUR RIGHTS CONCERNING THE PROTECTION OF PERSONAL DATA

We process your personal information transparently, legally and correctly. As a data subject, you have the right to contact us at any time to obtain information about the processing of your personal information.

It's up to you:

the right to access personal data - you have the right to request a copy of your personal data that GASTROLAND collects about you.
Right to repair personal information - If you believe that personal information we hold about you is inaccurate or incomplete, you have the right to ask us to update or update it;
the right to delete personal data (the right to be forgotten) - you have the right to request the deletion of your personal data if it is not necessary for the purpose for which it was processed, if you have withdrawn consent to its processing, was unlawfully processed, or were collected in connection with the provision of information society services;
right to restrict the processing of personal data - you have the right to request a limitation of processing if you deny the accuracy of your personal data or are unlawful, but you do not want to erase such personal data or if you ask us, we can process your selected personal data even after you are not (for example, in connection with the claim of the court in which you have the personal data you have processed) or you have objected to the processing, and it is not clear whether our legitimate interest outweighs your legitimate interests;
the right to portability of personal data - in the case of automated processing of personal data based on a contract or consent you have given us, you are entitled to the so-called portability of this data provided to you in a structured, commonly used and machine readable format, with whom Gastroland works;
right to object to the processing of personal data - at any time you may object to the processing of your personal data. You may also object to processing in the situation that we process your personal data for direct marketing purposes. In that case, we will no longer process your personal data for this purpose;
Right to withdraw consent to the processing of personal data - If you have given us permission to process personal data for purposes that require consent, you have the right to revoke your consent at any time. The processing of personal data that occurred prior to withdrawal of consent is legal;
the right to file a complaint with the Supervisory Authority, which is the Office for Personal Data Protection.

We will respond to your requests regarding the exercise of your rights without undue delay within one month of receipt of the request. However, the deadline may be extended by another two months if necessary. Such an extension, including the reasons that led to it, will always inform you. Communicate in the way you prefer (email, letter). Please note that prior to processing the request, we are authorized to validate your identity in a plausible manner to ensure that the information is provided to the authorized data subject.
